29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Mountain High Custom Concrete, LLC at 461 Railroad Ave, Gypsum, CO 81637: On or before May 7, 2019 the exposing employer did not ensure that employees were protected from injury while they installed concrete footers at the bottom of a foundation excavation, in that a protective system was not used. Employees installed footers in close proximity to the 12 foot vertical excavation side walls. The excavation was approximately 33 feet by 45 feet. This condition exposed employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement: (a) Mountain High Custom Concrete, LLC at 461 Railroad Ave, Gypsum, CO 81637: On or before May 7, 2019 the exposing employer did not ensure rebar caps were placed on the top-end of exposed vertical rebar located at the bottom of an excavation. Employees used egress ladder which was placed directly above exposed rebar at north end of excavation. The excavation was approximately 12 feet in depth. This condition exposed employees to impalement hazards.
