29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) Production area- On or about May 9, 2019 and at times prior, employees were exposed to a health hazard in that, the employer had not established or implemented a hazard communication program to include a written program and maintaining safety data sheets for current products used. Employees were exposed to hazardous substances such as, but not limited to, hexavalent chromium, a component of stainless steel welding fumes; 1,3,5-triglycidyl isocyanurate (TGIC), a component of the powder coating; argon; and phosphoric acid, a component of Phos-Tize.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Production area- On or about May 9, 2019 and at times prior, employees were exposed to a health hazard in that, the employer had not conducted hazard communication training including the hazards associated with the chemicals in use and safety data sheets and their location. Employees were exposed to hazardous substances such as, but not limited to, hexavalent chromium a component of stainless steel welding fumes, 1,3,5-triglycidyl isocyanurate (TGIC) a component of the powder coating, argon, and phosphoric acid a component of Phos-Tize.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Powder Coating area- On or about May 9, 2019, and at times prior, the employer exposed employees to a respiratory hazard in that, the employer had not established or fully implemented a respiratory protection program for employees required to wear respiratory protection while powder coating metal parts. There was no written program, medical evaluations, fit-testing, and training.    (b) Grinding/Sanding area-On or about May 9, 2019, and at times prior, the employer exposed employees to a respiratory hazard in that, the employer had not established or fully implemented a respiratory protection program for employees required to wear respiratory protection while sanding and/or grinding on metal parts. There was no written program, medical evaluations, fit-testing, and training.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a) Throughout the facility- On or about May 9, 2019, and at times prior, the employer exposed employees to a safety hazard in that, an employee who operates forklifts in the facility had not been evaluated at least every three years. The employee received forklift training on August 25, 2015 and the 3-year evaluation was due in 2018.
