OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards.   On or about May 10, 2019, and at times prior thereto, the employer did not ensure the Baler located in the back baling line department was equipped with an operational emergency stop button (E-stop), exposing employees to caught-in hazards.

29 CFR 1910.145(f)(3): Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily apparent.   On or about May 10, 2019, and at times prior thereto, the employer did not ensure the baler machine had the appropriate hazard warnings posted on the door and in danger areas to alert employees of the hazards associated with the machine operations, exposing employees to struck by, caught in or amputation hazards.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   On or about May 10, 2019, and at times prior thereto, the employer did not ensure machines were adequately guarded either at the point of operation or over the foot pedals that activate machines exposing employees to struck by, caught in or amputation hazards:  a)  There are approximately 7 foot pedals that are used on two Filler lines.  Filler Line #1 has 3 foot pedals not guarded; Filler Line #2 has 4 foot pedals not guarded; exposing employees to accidental actuation of the machine; and  b)  The Baler located in the Back Baling Line side guard was damaged with a large hole in the guard exposing employees to caught in and amputation hazards.

29 CFR 1910.305(b)(1): Unused openings in boxes, cabinets, or fittings were not effectively closed:   On or about May 10, 2019 and times prior thereto, the employer did not ensure unused openings in electrical panel boxes were effectively closed exposing employees to electrical shock hazards;  a)  in the back baler area, the electrical box that powered the box fan had knockouts missing exposing the internal live parts; and  b)  outside the Filler Line 1 department in the aisle way, the electrical box had a knockout missing exposing the internal live parts.

29 CFR 1910.305(g)(2)(iii): Flexible cords were not connected to devices and fittings so that tension would not be transmitted to joints or terminal screws.   On or about March 8, 2019, and at times prior thereto, the employer did not ensure the electrical cords exiting a power box was protected by strain relief exposing employees t electrical shock hazards:  a)  The Baldor motor cord was pulled down from its strain relief placing strain on the wires, and   b)  The box fan cord was pulled out and away from its fittings, exposing employees to electrical shock hazards.
