29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      East side of the construction building:  On or about May 14, 2019, employees were exposed to a fall hazard, while the aerial lift operator was not trained and evaluated on the safe operation of a Boom Lift-45 Telescopic 4WD Engine.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:    East side of the construction building:  On or about May 14, 2019, and at times prior thereto, employees were exposed to a fall hazard, while welding the rail ways on the exterior building from a Boom Lift-45 Telescopic 4WD Engine without fall protection equipment.
