29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about May 14, 2019, at 10290 NW 9th Street Circle, Indian Lake Village Condo, Miami, Florida, 33172, an employee was placing tiles on a flat roof, at approximately 12 feet from ground level; the employee was exposed to a fall hazard from a ladder that did not extend 3 feet from the landing surface. NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: On or about May 14, 2019, at 10290 NW 9th Street Circle, Indian Lake Village Condo, Miami, Florida, 33172, employees were engaged in roofing activities on a low-slope roof, greater than 50 feet in width, with unprotected sides and edges 6 feet or more above lower levels, and were not protected from falling by a guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system; therefore exposing the employees to a fall hazard. The MG EXCELLENCE SERVICES CORPORATION was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1230010, citation number 1, item number 1, and was affirmed as a final order on 6/27/2017, with respect to a workplace located at 2801 NW 103rd Street, Miami FL, 33147.
