29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of hazardous energy when employees or contractor employees were engaged in activities such as servicing and/ or maintenance of equipment: Employees were exposed to a crushing hazard. A contract or temporary worker engaged in welding a crack in a metal hopper for the North Carolina Line was exposed to a crushing hazard. Lockout / tagout was not being utilized to control all energy sources of the machine prior to maintenance work being performed.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees: Employees were exposed to a crushing hazard. Contractor or temporary workers engaged in performing maintenance and preventive maintenance on hard wired equipment such the North Carolina Line were exposed to crushing hazards. Inadequate lockout / tagout training was provided to employees. No lockout / tagout was being used when a contractor or temporary worker was crushed by the unloading track of the North Carolina Line.

29 CFR 1910.147(f)(2)(i): When outside servicing personnel were engaged in activities in a facility, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures: Employees were exposed to crushing hazards. On or about February 20, 2019 a contract / temporary worker engaged in welding a crack in a metal hopper for the North Carolina Line was exposed to a crushing hazard. No lockout / tagout was used to control all energy sources. Canyon Stone and the contract / temporary worker did not communicate to each other their respective lockout / tagout procedures prior to starting the welding work on the North Carolina line.
