Employees of a subcontractor were working within the trusses of the structure approximately 25 feet above grade without any means of fall protection.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and/or the fork-lift was moved horizontally while the platform was occupied: a) 1004 Coleman Street-Wilmington, DE: On or about May 15, 2019, the employer did not ensure that the entire work platform being used to elevate individuals on a JCB Rough Terrain Telescoping Forklift, Model SH320, was secured to the forks. Employees of a subcontractor were working from an unapproved and unsecured work platform constructed of stacked plywood while engaged in residential construction activities at heights of approximately 12 to 15 feet above grade. b) 1004 Coleman Street-Wilmington, DE: On or about June 27, 2019, the employer did not ensure that the entire work platform being used to elevate individuals on a JCB Rough Terrain Telescoping Forklift, Model SH320, was secured to the forks.
