29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them):    (a)Premier Systems, Inc. at 1301 South Lindenwald Drive, Sioux Falls, SD 57106:  On or about and at times prior to May 14, 2019, the controlling and exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The controlling employer did not ensure subcontractor employees were protected from fall hazards while conducting re-roofing operations on a single-family home without a fall protection system. Additionally, subcontractor employees were exposed to a fall hazard associated with the extension ladder to the roof not extended at least three feet above the roof to provide safe access. This condition exposed employees to fall hazards of approximately 10 and 19 feet.     Premier Systems, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1245376, citation number 1, item number 1 and was affirmed as a final order on October 27, 2017, with respect to a workplace located at 3800 East 15th Street, Sioux Falls, SD 57103.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)Premier Systems, Inc. at 1301 South Lindenwald Drive, Sioux Falls, SD 57106: On or about and at times prior to May 14, 2019, the controlling employer did not ensure that subcontractor employees were protected from falls. Subcontractor employees were conducting re-roofing activities on a single-family home without the use of a fall protection system. This condition exposed subcontractor employees to a fall hazard of approximately 10 to 19 feet.    Premier Systems, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 988110, citation number 1, item number 1 and was affirmed as a final order on August 28, 2014, with respect to a workplace located at 509 Hughes Avenue, Sioux Falls, SD 57104.
