OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a crushing hazard: a. On or about May 15th, 2019, at 5534 Yahl Street, Suite A2, Naples, Florida 34101, the employer failed to protect workers who were exposed to a crush-by hazard from the tipping over of crates containing mirrors, while unloading the crates from a cargo container of a truck.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a. On or about May 15th, 2019, at 5534 Yahl Street, Suite A2, Naples, Florida 34101, an employee was not trained to operate a forklift with a boom attachment, prior to using the equipment to unload cargo from a container of a truck, thus exposing employees to a crushing hazard.
