29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about May 15, 2019, employees were exposed to cave-in hazards while conducting pipe connections in an unprotected trench. The competent person determined that the trench required cave-in protection, but failed to have the trench protection installed in all portions where employees were exposed to cave-in hazards nor had a ladder in the trench for employees to exit the trench.

(a) At the construction site located near 526 Crossway Rd, Fox Point, WI employees were performing work in an approximately 8.8 feet deep excavation without adequate cave-in protection, thereby exposing employees to a struck-by / crushing hazard.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about May 15, 2019, employees were working in a trench approximately 8.8 feet in depth without a safe means of egress. The Woods Sewer and Excavation, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1081803, citation number 1, item number 1, and was affirmed as a final order on 10/14/15, with respect to a workplace located at W Verbrick Street and S Sanders Street, Appleton, WI 54915.
