29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) A lead operator in the Mono Plant was exposed to continuous noise levels at 55.5% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 55.5% is approximately 85.7 dBA. Sampling was performed for 708 minutes during one shift. The action level was adjusted from 85.0 dBA to 82 to account for the extended shift of more than 8 hours. (b) A machine operator in the Coex Plant was exposed to continuous noise levels at 73.8% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 73.8% is approximately 87.8 dBA. Sampling was performed for 711 minutes during one shift. The action level was adjusted from 85.0 dBA to 82 to account for the extended shift of more than 8 hours. (c) A helper in the Coex Plant was exposed to continuous noise levels at 76.6% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 76.6% is approximately 88 dBA. Sampling was performed for 710 minutes during one shift. The action level was adjusted from 85.0 dBA to 82 dBA to account for the extended shift of more than 8 hours. (d) A helper in the Mono Plant was exposed to continuous noise levels at 53.5% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 53.5% is approximately 85.4 dBA. Sampling was performed for 712 minutes during one shift. The action level was adjusted from 85.0 dBA to 82 dBA to account for the extended shift of more than 8 hours.
