29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.       a. On or about May 23, 2019, at the former Knights Inn motel and restaurant demolition site, employees spraying a mixture of Penewet RTU No. 6450/water and using tools, including pry bars, spud bars and shovels, to open locked doors, remove A/C units, and remove asbestos containing floor tile were not protected with safety glasses or equivalent eye protection.

29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.    a. Prior to May 20, 2019, at the former Knights Inn motel and restaurant demolition site, the employer did not ensure that an initial exposure assessment was conducted to ascertain expected employee exposures during the removal of asbestos containing floor tile and to provide information necessary to assure that all control systems planned were appropriate for that operation and would work properly.

29 CFR 1910.1200(f)(6): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either:  1910.1200(f)(6)(i), The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, 1910.1200(f)(6)(ii), Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.    a. On or about May 23, 2019, at the former Knights Inn motel and restaurant demolition site, spray tanks containing a mixture of Penewet RTU No. 6450 and water for wetting asbestos containing material prior to removal were not labeled.
