29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: The employer is failing to protect employees from fall hazards. This was most recently occurred at 768-331 Rural Perkins County, Grant, Nebraska 69140 on or about May 14, 2019. The employer failed to ensure that fall protection was used by employees working on a supported scaffold that was approximately 19 feet above the ground which was attached to a Caterpillar material handler. An employee fell to the ground and was injured when they stepped off the scaffold without fall protection.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards as required by paragraph (a)(1) of this section: The employer is failing to protect employees from fall hazards. This was most recently occurred at 768-331 Rural Perkins County, Grant, Nebraska 69140 on or about May 14, 2019. Instance a) The employer failed to ensure that fall protection was used by employees working on a supported scaffold that was approximately 19 feet above the ground which was attached to a Caterpillar material handler were trained to the nature of fall hazards as a result of the condition of the scaffold that had a lack of fall protection. Instance b) The employer failed to ensure that fall protection was used by employees using a Genie S-45 aerial lift were trained to the nature of fall hazards as a result of the condition of the scaffold that had a lack of fall protection.
