29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: (a)Salvador Mota dba Mota Drywall at 1310 West 30th Street, Yankton 57078: On or about and prior to April 24, 2019, the employer did not ensure an employee was protected from fall hazards while working in close proximity to a wall opening. The employer removed the window in order for an employee to throw trash into a trash skip located below the window. The condition exposed an employee to a fall hazard of approximately 12 feet.
