JOBSITE: The employer did not ensure that adequate precautions had been taken to protect employees from the hazards posed by water accumulation while connecting water main to an orange valve in the 5 feet 2 inches to 5 feet 7 inches deep, 5 feet wide and 32 feet long trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. JOBSITE: A competent person had not conducted daily inspections for evidence of situations that could result in possible cave-ins or other hazardous conditions prior to allowing employees to enter the 5 feet 2 inches to 5 feet 7 inches deep, 5 feet wide and 32 feet long trench to install and connect a water main.

29 CFR 1926.652(a)(1): Employees were not protected in an excavation from a cave-in by an adequate protective system designed in accordance with paragraph (b) and (c) of this section. JOBSITE: The employees performing tasks, such as (but not limited to) connecting a water main to a valve in the 5 feet 2 inches to 5 feet 7 inches deep, 5 feet wide and 32 feet long trench were not protected from the hazard of cave-ins by the use of appropriate cave-in protection systems/devices. On or about 05/17/2019, the north wall of the trench caved in causing one of employees performing the above task to sustain a fractured pelvis.
