29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about May 21, 2019, located at 341 Main Street in Gnadenhutten, Ohio, the employer did not initiate and maintain safety and health programs for employees working from heights on a steep-pitched roof and working from ladders, thereby exposing the employees to falls and other hazards associated with residential roofing work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about May 21, 2019, located at 341 Main Street in Gnadenhutten, Ohio, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the regulations for employees working from heights on a steep-pitched roof and working from ladders, thereby exposing the employees to falls and other hazards associated with residential roofing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about May 21, 2019, located at 341 Main Street in Gnadenhutten, Ohio, employees were performing residential roofing work on a 7/12 pitch roof without fall protection, thereby exposing the employees to a maximum fall hazard of approximately 24 feet.
