29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: The employer is failing to protect employees from cave in hazards associated with excavations. This was most recently observed at 20576 NE 370, Gretna, Nebraska on May 22, 2019 when employees were working in and around an excavation and a test was not performed to determine the class of soil. Soil classification as part of an inspection is needed to determine the type of protective system required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): The employer is failing to protect employees from the hazards associated with trenching and excavation work. This was most recently observed at 20576 NE 370, Gretna, Nebraska on May 22, 2019 when two employees were working in an unprotected trench that was over 6' deep, with vertical walls and no protective systems were in place.
