29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a) On or about May 21, 2019; second floor; employees were not wearing eye protection while operating portable tools such as but not limited to nail guns.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      a) On or about May 21, 2019, second-floor area; employees were observed walking the top-plate while framing the new residential home without fall protection in place to protect them falling approximately 10-feet to the wooden floor or 27-feet to ground level.        b) On or about May 21, 2019, second-floor area; during the framing process employees were observed working near wall openings without fall protection to protect them falling approximately 27-feet to ground level.       b) On or about May 21, 2019, second-floor area; during the framing process employees were observed working near floor openings without fall protection to protect them falling approximately 10-feet to the lower level. 29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.    a) On or about May 21, 2019, the employer had not certified the fall protection training for employees who were exposed to fall hazards up to approximately 27 feet while performing framing work.
