29 CFR 1926.21(b)(2): (Employer responsibility.) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On May 21, 2019, located at a commercial structure, employees were working from a JLG 450AJ articulating boom lift while not utilizing a fall protection system and exposed to potential fall heights greater than 34 feet above ground level. The employer did not instruct employees in the proper use of an aerial lift and in the recognition and avoidance of those hazards of which a reasonably prudent employer would have been aware of while performing this work.

29 CFR 1926.453(b)(2)(iv): ("Specific requirements.")(Extensible and articulating boom platforms.) Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. On May 21, 2019, located at a commercial structure, employees were performing elevated work while standing on the midrails of a JLG 450AJ articulating boom lift without use of an effective fall protection system. Potential fall heights were determined to be greater than 34 feet above ground level.

29 CFR 1926.453(b)(2)(v): ("Specific requirements.")(Extensible and articulating boom platforms.) A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On May 21, 2019, located at a commercial structure, employees were working from a JLG 450AJ articulating boom lift without being attached to the boom or lift and exposed to potential fall heights greater than 34 feet above ground level.
