29 CFR 1926.21(b)(2): (Employer responsibility.) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On May 8, 2019, located at a commercial structure, employees working from a JLG 400S extensible boom lift while not utilizing a fall protection system were exposed to potential fall heights greater than 25 feet above the ground below. The employer did not instruct employees in the proper use of an aerial lift and in the recognition and avoidance of those hazards of which a reasonably prudent employer would have been aware of while performing this work.

29 CFR 1926.453(b)(2)(v): ("Specific requirements.")(Extensible and articulating boom platforms.) A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  On May 8, 2019, located at a commercial structure, employees were working from a JLG 400S extensible boom lift without being attached to the boom or lift and exposed to potential fall heights greater than 25 feet above the ground below.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On May 8, 2019, located throughout a commercial roof structure, employees were working from a low-slope roof with unprotected sides and edges while not utilizing a fall protection system and exposed to potential falls greater than 25 feet above the ground below.

29 CFR 1926.502(a)(2): ("General.") Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  On May 8, 2019, located at a commercial roof structure, employees were not provided with fall protection equipment before working at the unprotected side or edge and were exposed to potential fall heights greater than 25 feet above the ground below.

29 CFR 1926.503(a)(1): ("Training Program.") The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide a training program for employees performing work from a low-slope commercial roof structure while not utilizing a fall protection system and exposed to potential fall heights greater than 25 feet above the ground below.
