5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee were walking in the swing radius of heavy equipment, (Caterpillar 330L) exposing workers to struck-by and crush-by hazards.   On May 21, 2019, a Caterpillar 330 BL excavator was in the process of drilling caissons. The excavator counterweight was positioned in proximity to concrete barriers that created a pinch point. An employee was caught between the rotating excavator counterweight and concrete barriers.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
