29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:  On or about May 21,2019, at 7167 Interpace Rd. Riviera Beach, FL 33407, an employee in the TIGER machine area who was a quality control paver machine operator was exposed to a noise level of 91.0 dBA, which exceeds the action level of 84.5dBA during the 9-hr representative sampling period. The employee was not provided with a baseline audiogram after being at the facility for more than one (1) year.

Riviera Beach, FL 33407 production facility,  employees exposed to respirable crystalline silica while fabricating brick pavers were not repeated sampling for respirable crystalline silica exposure by the employer after finding exposure above the permissible exposure level (PEL).

29 CFR 1910.1053(c): The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50ug/m3, calculated as an 8-hour TWA:  Instances:  a) On or about June 7, 2019, at 7167 Interpace Rd. Riviera Beach, FL 33407 production facility,  an employee fabricating pavers (OMAG dry Operator)  was exposed to a respirable crystalline silica level of 74.092 micrograms/cubic meter, which exceeds the permissible exposure limit (PEL) of 50 micrograms/cubic meter. The sampling was performed for 474 minutes, and zero exposure was assumed for the unsampled time.   b) On or about June 7, 2019, at 7167 Interpace Rd. Riviera Beach, FL 33407 production facility, an employee fabricating pavers (OMAG dry side operator) was exposed to a respirable crystalline silica level of 58.346 micrograms/cubic meter, which exceeds the permissible exposure limit (PEL) of 50 micrograms/cubic meter. The sampling was performed for 480 minutes.  The Old Castle APG South Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1000(c), which was contained in OSHA inspection number 1035453, citation number 1, item number 2a and was affirmed as a final order on 07/26/2016, with respect to a workplace located at 4083 Bonsal Rd Conley Georgia, 30288.

29 CFR 1910.1053(f)(1): The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible:  On or about June 7, 2019, at 7167 Interpace Rd. Riviera Beach, FL 33407 production facility, operators of the paver manufacturing machine (OMAG) were over-exposed to respirable crystalline silica while engineering and/or work practice controls were not used at the facility.  The Old Castle APG South Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1000(c), which was contained in OSHA inspection number 1035453, citation number 1, item number 2b and was affirmed as a final order on 07/26/2016, with respect to a workplace located at 4083 Bonsal Rd Conley Georgia, 30288.
