29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a. Located at 223 Lockville Road in Pickerington, Ohio: On or about May 24, 2019, the employer did not ensure that the soil pile on the north side of the trench was placed at least two foot from the top edge, thereby exposing the employee working in the trench to crushed by hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. Located at 223 Lockville Road in Pickerington, Ohio: On or about May 24, 2019, the employer did not ensure that the employee shooting grade, laying gravel and laying pipe in an approximately nine foot deep trench which extended from the roadway was provided with an adequate means of cave in protection in accordance with the 1926.652 requirements, thereby exposing the employee to crushed by hazards. b. Located at 223 Lockville Road in Pickerington, Ohio: On or about May 24, 2019, the employer did not ensure that the employee using a probe rod in the bottom of an approximately nine foot deep trench which extended from the house foundation was provided with an adequate means of cave in protection in accordance with the 1926.652 requirements, thereby exposing the employee to crushed by hazards.
