29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) Warehouse - On or about May 3, 2019, the employer failed to ensure that employee(s) who operate the Hyster powered industrial truck, Hyster #9, model #E50XN-27, serial #A268N20625R were properly trained, evaluated and certified to perform the tasks in a safe manner.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of the incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on OSHAs public web site at www.osha.gov:    a) Gemco Roofing & Building Supply, Inc. - The employer did not report an in-patient hospitalization that resulted from a work-related incident that occurred on or about May 3, 2019, to OSHA within twenty-four (24) hours.  The injury was reported to OSHA on May 16, 2019.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service and were placed in service when the examination showed condition(s) that would adversely affect the safety of the vehicle:   a) Warehouse/Yard Area - On May 23, 2019, the employer did not ensure the Hyster #4, sit down forklift, model #E50Z, serial #G108V03237B, was examined before being placed in service.  This forklift was being operated with a missing pedal cover.    b) Warehouse/Yard Area - On May 23, 2019, the employer did not ensure the Hyster #5, sit down forklift, model #E50Z, serial #G108V03746C, was examined before being placed in service.  This forklift was being operated with a missing pedal cover.    c) Warehouse/Yard Area - On May 23, 2019, the employer did not ensure the Hyster #7, sit down forklift, model #E50XN-27, serial #A268N14590M, was examined before being placed in service.  This forklift was being operated with a missing pedal cover.
