29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems: (a)Eulalio Lopez dba E&M Contracting at 5009 South Galway Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 23, 2019, the exposing employer did not ensure employees were protected from injury in that, employees engaged in re-roofing activities on a roof of a single-family home with a 5 in 12 pitch were exposed to fall hazards. This condition exposed employees to a fall hazard of approximately 13 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards: (a)Eulalio Lopez dba E&M Contracting at 5009 South Galway Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 23, 2019, the exposing employer did not ensure employees engaged in re-roofing operations on a single-family home, had been trained to recognize the hazards associated with working at elevations over 6 feet. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 13 feet.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing, and was not secured: (a)Eulalio Lopez dba E&M Contracting at 5009 South Galway Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 23, 2019, the exposing employer did not ensure that a portable Keller KPro extension ladder was used correctly. The side rails did not extend 3 feet above the upper landing, nor was the ladder secured. This condition exposed the employees to fall hazards of 9 feet measured from eave to ground.
