Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn hazards. a) On or about May 22, 2019, and times prior, the employer, LMP Enterprises, Inc. d/b/a Captain D's failed to provide a place of employment free from the recognized hazard of burn injuries resulting from the requirement to change-out and handle hot grease from the Arnets SLG50 "Country Pot" deep fryer. 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On or about May 22, 2019, and times prior, the employer, LMP Enterprises, Inc. d/b/a Captain D's did not provide appropriate personal protective equipment, including, but not limited to, insulated/oil resistant gloves, sleeves and aprons, as well as eye and face protection for employees exposed to burn hazards of approximately 350 degrees Fahrenheit when required to filter or change hot grease from the Anets SLG50 "Country Pot" deep fryer. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
