29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:  The employer failed to provide documentation demonstrating the abatement methods and completion as cited in Citation 1 Item 1 for not ensuring employees were trained on how to recognize and minimize fall hazards located at The Reserves at Winfield Farms in Elyria, Ohio.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about 5/29/19, during residential framing activities located at The Reserves at Winfield Farms in Elyria, Ohio, the employer failed to ensure that employees exposed to fall hazards were provided fall hazard awareness training that included methods to minimize fall hazards. Employees were working at a height of over nine (9) feet without fall protection.

29 CFR 1926.1053(a)(3)(i): Rungs, cleats, and steps of fixed ladders were spaced more than 14 inches (36 cm) apart, as measured along the ladder's side rails:  On or about 5/29/19, during residential framing activities located at The Reserves at Winfield Farms in Elyria, Ohio, the employer failed to ensure that the job made ladders were designed in accordance with 29 CFR 1926.1053(a). The steps on the job made ladder were about twenty-three (23) inches apart.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about 5/29/19, during residential framing activities located at The Reserves at Winfield Farms in Elyria, Ohio, the employer failed to ensure that employees working at a height greater than nine (9) feet were provided and utilized fall protection.  JR Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1251786, citation number 1, item number 1, and was affirmed as a final order on 9/27/17, with respect to a workplace located at Detroit Road in Lakewood, Ohio.
