OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the bucket of a backhoe.    a)  Barone Road & Syme Avenue, West Orange, NJ.    On or about 05/23/2019, a laborer in an excavation, while guiding a concrete catch basin suspended by rigging attached to the backhoe's boom, was struck by the side of the bucket and pushed up against the excavation's wall.

29 CFR 1926.651(k)(1):     An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a)  Barone Road & Syme Avenue, West Orange, NJ.    A daily inspection of the excavation was not made by a competent person.  The excavation had visible deficiencies, such as but not limited to, a lack of safe egress with no ladder or ramp in the excavation, a sidewalk being undermined by the excavation and a backhoe bucket being moved in the excavation with a worker within striking distance.
