29 CFR 1926.453(a)(2): Aerial lifts were "field modified" for uses other than those intended by the manufacturer, the modification had not been certified in writing by the manufacturer or by any other equivalent entity. Modification did not conform with all applicable provisions of ANSI A92.2-1969:      On or about May 29, 2019, the employer failed to obtained the manufacture's approval before modifying the mid-rail of the basket of the Snorkel articulating boom lift: model #TB-66JDZ, serial #SP06177. The mid-rail was taped to the top-rail which allowed employees to crawl in and out of the lift's basket. The component was not replaced with a gate or similar device, and although employees were don in harnesses and lanyards; they were not tied off and were thus exposed to a fall of approximately 15(+) ft.

29 CFR 1926.501(b)(15): Employees walking/working on a surface 6 feet (1.8m) or more above lower levels that are not addressed in 1926.500(a)(2) or in 501(b)(1) through (b)(14) were not protected from falling by a guardrail system, safety net system, or a personal fall arrest system:     On or about May 29, 2019, while in the process of cleaning the brick exterior of a commercial property located at 6200 Oak Tree Blvd. in Independence, OH, an employee walking on a ledge of the building as he used a power washer was exposed to a fall hazard. Although the employee was don in a harness and lanyard, there were no anchor points or other fastener for him to tie off to thus exposing him to a fall of approximately 15(+) ft., from the top of the ledge to the concrete surface below.
