OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that operated the roll-bending machines: a) Fit-Tack/Welding Area, 155 S.R. 61 S, Schuylkill Haven, PA - Built-Rite Mfg., Inc. New Dimension Initial Pinch Power Roll Model P3-250 (Serial No. 04991703) roll-bending machine was not equipped with a functioning emergency stop device and the foot pedal was placed within the danger zone/point of operation, exposing employees to caught-in hazards, as observed on or about May 29, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: a) Welding, 155 S.R. 61 South, Schuylkill Haven, PA - Employees fed metal stock and sheet metal by hand into the unguarded thirty-eight (38) inch point of operation between the top roll and pinch roll of the Built-Rite Mfg., Inc. New Dimension Initial Pinch Power Roll Model P3-250 (Serial No. 04991703) roll-bending machine exposing the employees to a caught-in hazard, as observed on or about May 29, 2019. In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
