29 CFR 1910.28(b)(3)(iv): (iv) Each employee is protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used.  On or about May 29, 2019, Wisconsin Paint and Powder Coating did not provide a self-closing gate or offset at the entrance to access platforms 1, 2 or 3 for the 5 Stage Parts Washer.

29 CFR 1910.29(b)(1): (1) The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface.  The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11).  On or about May 29, 2019 the top rail of the guardrail system for access platforms 1, 2 and 3 did not meet the minimum height requirements for providing fall protection as a guardrail system.

29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.    On or about May 29, 2019, an exit door marked #3 near the eastern spray booth was locked and bolted preventing easy egress in the event of an emergency.

29 CFR 1910.37(b)(6): Each exit sign must be illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and be distinctive in color. Self-luminous or electroluminescent signs that have a minimum luminance surface value of at least .06 footlamberts (0.21 cd/m2) are permitted.    On or about May 29, 2019 Wisconsin Paint and Powder did not maintain illuminated Exit signs in the following areas:    a) an elevated Exit sign showing the exit route from the sandblasting and rim blaster area.    b) an elevated Exit Sign showing the exit route halfway down the southside of the parts washer.     c) an elevated Exit sign showing the exit route on the southside of the part dryer.

Combustible waste material and residues in a building or unit operating area shall be kept to a minimum, stored in covered metal receptacles and disposed of daily.    On or about May 29, 2019, Wisconsin Paint and Powder Coat was storing used Supertuff Paint Strainers that had been coated with flammable used paint on top of an empty paint bucket outside of the liquid spray booth.

The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    On or about May 29, 2019, Wisconsin Paint and Powder Coat had not developed an Energy Control Program to ensure that employees conducting maintenance or service activities are protected from the hazards of unintended re-energization.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    On or about May 29, 2019, Wisconsin Paint and Powder Coat had not evaluated their forklift operators every three years to ensure that the operators were capable of safely operating the forklifts.
