29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    The employer did not develop a written energy control program to include energy control procedures and periodic inspections exposing employees to inadvertent restart of equipment.

29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.  The employer did not develop and document energy control procedures, on the multiple energy sources pieces of equipment, exposing employees to accidental/inadvertent restart of the equipment.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    In the Pizza Room, the Pizzazio cheese shredder was not guarded between the plunger and the cheese and the cheese and rotating shredder blades exposing employees to caught between and struck by hazards.

29 CFR 1910.219(f)(3): Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.    (a)  On or about May 23, 2019, in the Pizza Room, the Conflex (Model:  CW 160, S/N:  C0702-187) had an unguarded chain and sprocket on the outfeed side exposing employees to caught in between hazards.      (b)  On or about May 23, 2019, in the Pizza Room, the Conflex (Model:  CW 160, S/N:  C0702-187) had an unguarded chain and sprocket on the infeed side exposing employees to caught in between hazards.

29 CFR 1910.219(c)(4)(i): Projecting shaft ends shall present a smooth edge and end and shall not project more than one-half the diameter of the shaft unless guarded by nonrotating caps or safety sleeves.    In the Pizza Room, the Quantum cheese machine had a 1 1/2" diameter shaft which extended approximately 2 1/8" exposing employees to entanglement hazards.
