29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  Fernando Calsonzi, dba Fernando Hernandez Construction, did not provide abatement certification within 10 days of the date specified on the previously issued Citation 1, Item 1, and Citation 2, Item 1, which was November 19, 2019.

29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  Fernando Calsonzi, dba Fernando Hernandez Construction, failed to provide documentation demonstrating the abatement method and completion date for the previously issued  previously issued Citation 1, Item 1, and Citation 2, Item 1.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On May 30, 2019 at 1200 E Meadow Grove in Appleton, an employee was working on a roof surface fifteen feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On May 30, 2019 at 1200 E Meadow Grove in Appleton, the employer did not provide required fall protection safety training for an employee who did not associate fall from elevation hazard when working on a roof surface fifteen feet above surface level without utilizing fall protection equipment.
