29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect employee health or whenever respirators are required by the employer, a written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented.  On or about May 28, 2019 and at times prior thereto, employee(s) were required to wear a respirator during tasks including but not limited to floor polishing when chemicals such as xylene are used, exposing the employee(s) to the hazards of respirator use. The employer did not implement a written respiratory protection program. Such program shall include but not be limited to the following:  a) Ensuring employees are medically cleared to wear a respirator.  b) Ensuring respirators are stored to protect against contamination.  c) Prohibiting facial hair to ensure a good respirator to face seal.   d) Training on proper use and care of respirators.

29 CFR 1910.1053(i)(2): The employer did not make available an initial (baseline) medical examination within 30 days after initial assignment when the employee had not received a medical examination that meets the requirements of this section within the last three years.  On or about May 28, 2019 and at times prior thereto, the employer did not make initial medical examinations available for employees performing floor resurfacing job task, exposing employees to the hazards of inhaling silica dust.

On or about May 28, 2019 and at times prior thereto, employee(s) performing job tasks including but not limited to, the grinding of concrete floors, did not demonstrate knowledge and understanding of health hazards associated with the dust created by the job task, exposing employee(s) to the hazards of respirable crystalline silica.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.  On or about May 28, 2019 and at times prior thereto, employee(s) handling hazardous chemicals such as but not limited to; SRG Part A polyol and Part B ISO, Consolideck LSGaurd, and 3DHS, could not demonstrate the knowledge and understanding of the hazards associated with these chemicals in their workplace, exposing employee(s) to inhalation, ingestion, and/or absorption hazards.
