29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)G & N Exteriors, LLC at 809/811 Horizon Lane, Sioux Falls, SD 57106: On or before and at times prior to May 28, 2019, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards from while installing roofing materials on a multi-family residence. The condition exposed employees to fall hazards from 9 to 15 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)G & N Exteriors, LLC at 809/811 Horizon Lane, Sioux Falls, SD 57106: On or before and at times prior to May 28, 2019, the exposing employer did not ensure that employees working on a residential property were protected from fall hazards. Employees were installing underlayment and asphalt shingles on a multi-family residence and were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 9 to 15 feet.
