OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    The employer is failing to prevent employee exposure to laceration hazards.  On or about 5/25/2019, at 3863 McDonald Avenue, Saint Louis, MO  63116, an employee bucked tree branches with a Stihl MS 193T chainsaw while he stood on a 4:12 pitch carport roof.  The employee attempted to control a branch as it slid down the roof and failed to maintain control of the chainsaw.  The employee was fatally injured when the chainsaw lacerated his neck and left arm.      Feasible and acceptable methods of abatement to correct this hazard include but are not limited to the following:     a)    Follow the use of Chain Saw, Page 6, Holding and Controlling the Chain Saw, Page 11, Reactive Forces including Kickback, Page 15, as outlined in the STIHL Instruction Manual.    b)    Follow Portable Power Hand Tools, Section 6, and Work Procedures, Section 8, as outlined in the American National Standard for Arboricultural Operations, ANSI Z133.1-2006.  a) The employer is not limited to the abatement methods(s) suggested by OSHA.  b) The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  The employer is failing to access workplace hazards that require protective equipment.  On or about 5/25/19, the employer failed to assess the worksite to determine stuck-by, flying debris, laceration, and amputation hazards during tree trimming services.  Employees were exposed to overhead hazards due to working in proximity to tree trimming.  Employees were exposed to flying debris due to the use of a Stihl MS-193T chainsaw while trimming branches and limbs.  Employees were exposed to laceration and amputation hazards due to the use of a Stihl MS-193T chainsaw.  The employer did not provide employees with hard hats, safety glasses, face shield,, or protective clothing (i.e. chaps).

On or about 5/25/2019, at 3863 McDonald Avenue, Saint Louis, MO  63116, the employer did not provide training in the recognition of job site hazardous conditions to each employee, such as fall hazards, struck-by hazards to the eye or face and struck-by hazard from overhead falling objects, i.e., tree limbs and debris.

On or about 5/25/2019, at 3863 McDonald Avenue, Saint Louis, MO 63116, an employee who was engaged in tree trimming and removal services was fatally injured and pronounced dead on 05/25/2019.  The employer did not report the death to Occupational Safety & Health Administration (OSHA) U.S. Department of Labor.
