29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Winter Brothers Underground, Inc. at 32nd Street and South Kingswood Way, Sioux Falls, SD 57106: On or about and at times prior to May 31, 2019, the exposing employer did not ensure that employees conducting work in an excavation were protected from cave-in. Employees were installing a water line within an excavation approximately eight feet deep and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed an employee to struck-by hazards associated with a an 8-foot trench wall collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)Winter Brothers Underground, Inc. at 32nd Street and South Kingswood Way, Sioux Falls, SD 57106: On or about and at times prior to May 31, 2019, the exposing employer did not ensure that daily inspections of a trench excavation, that was over five feet in depth, 13 feet in width, and 22 feet in length, and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent person did not identify that the trench inadequate benching resulting in an approximately 60 degree slope. This condition exposed employees to a crushing hazard by trench wall cave-in.

The condition exposed employees to fall hazards.

Employees onsite were utilizing separated sections of an extension ladder to access an excavation approximately eight feet in depth. This condition exposed employees to a fall hazard.
