29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Carl V. Carlson Company at 32nd Street and South Kingswood Way, Sioux Falls, SD 57106: On or about and at times prior to May 31, 2019, the exposing employer did not ensure that employees conducting work in an excavation were protected from struck-by hazards related to excavation wall cave-in. The excavation was approximately eight feet deep and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed an employee to struck-by hazards associated with a trench wall collapse.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)Carl V. Carlson Company at 32nd Street and South Kingswood Way, Sioux Falls, SD 57106: On or about and at times prior to May 31, 2019, the exposing employer did not ensure that daily inspections of a trench excavation that was over five feet in depth, 16 feet wide, and 17 feet in length. The competent person did not conduct a daily inspection that would have identified a situation that could have resulted in a hazardous condition in that, a vertical wall of soil approximately eight feet in depth located where the ladder was placed for access and where employees were working for cave-in exposure. This condition exposed employees to a crushing hazard by trench wall cave-in.
