29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501: (a) Alex Simental Construction LLC at 11251 Colony Row in Broomfield, CO 80021: On or before May 31, 2019 , the employer did not ensure that employees were protected from fall hazards while constructing residential patio decks. Employees were replacing decking on a 2nd story residential patio without the use of fall protection or a fall protection system. This condition exposed the employee to fall hazards of approximately 9 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet above the upper landing surface being accessed: (a) Alex Simental Construction LLC at 11251 Colony Row in Broomfield, CO 80021: On or before May 31, 2019, the employer allowed employees to access the second floor patio decks without ensuring that the ladders were extended up at least three feet. This condition exposed employees to fall hazards of approximately 9 feet.
