29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On June 4, 2019; three employees were on the roof, of building no 8 a two-story apartment building being built at 1003 Windmill Farms Blvd, Forney, TX approximately twenty-one (21) feet or more above the ground below and were not protected from a fall hazard by using either guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed; the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) On June 4, 2019 at least three employees were using an aluminum extension ladder set up against building number 8 at a worksite located at 1003 Windmill Farms Blvd, Forney, TX which was approximately 2 feet 6 inches above the upper landing thereby exposing the employee(s) using it to a fall hazard of approximately twenty-one (21) feet to the ground below.
