29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a.) Thornbury, Inc., jobsite located at the I-80 and route 308 overpass, Clintonville, PA, on or about June 5th, 2019 and times prior thereto: Employees utilized a Chicago pneumatic CP-4181 rivet buster (handheld powered chipping tool) to perform jackhammering operations of concrete on areas including, but not limited to, the pier area of the bridge. The employer did not ensure that a continuous water delivery system was utilized during all chipping/jackhammering operations of materials including, but not limited to concrete. Additionally, the employer did not assess employees exposure in that, the employer did not perform an exposure assessment for this operation per 29CFR1926.1153(d).
