OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing hazards from operating a powered industrial truck without a seatbelt: A. On or about June 10, 2019, Warehouse and Lot Areas: 1. An employee was observed operating the Mitsubishi propane-powered forklift, Model FG025K, S/N AF82C-02790, without wearing the seatbelt provided on the equipment. Powered industrial trucks were used to carry loads weighing an average of 1,300 lbs. 2. A Clark CS60-70 forklift was not provided with a seatbelt. The vehicle had been used two days prior to the inspection.
