29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) At the front of the building:  On or about 6/6/2019, an IBX employee working at approximately 14 feet in height was using a JLG scissor lift, model # 1930Es, serial # PC508 1022869, and was not protected by an adequate fall protection system or a guardrail system in that, the scissor lift had a mid-rail chain and no top rail to prevent the employee from falling out of the scissor lift.  (b) On the southeast end of the building:  On or about 6/6/2019, two IBX employees were performing work from a JLG scissor lift, model # 260MRT, serial # 0200131091, at approximately 12 feet in height, and were not protected from falling out of the scissor lift, in that, there was a top rail, but the midrail chain was not fastened to prevent either of the employees from falling out.
