29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about the five-day period of April 29 - June 3, 2019, located inside an urban one-lane, two way Temporary Traffic Control zone, there were no frequent and regular inspections being performed by a competent person in that employees were: not facing traffic and sitting down while performing flagging operations; and using hand movements for traffic control instead of appropriate signaling methods such as use of STOP/SLOW paddles.

On or about the five-day period of April 29 - June 3, 2019, located inside an urban one-lane, two way Temporary Traffic Control zone, employees were performing flagging operations that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.

29 CFR 1926.200(g)(2): The design and use of all traffic control devices, including signs, signals, markings, barricades, and other devices, for protection of construction workers shall conform to Part 6 of the MUTCD (incorporated by reference, see �1926.6). (a) On June 3, 2019, located inside an urban one-lane, two way Temporary Traffic Control zone, an employee not facing traffic and sitting down was performing flagging operations using hand movements and exposed to struck-by hazards while not utilizing appropriate signaling methods, such as facing road users in a stationary/standing position and use of STOP/SLOW paddles, that conform to Part 6 of the Manual of Uniform Traffic Control Devices. (b) On or about the four-day period of May 29 - June 2, 2019, located inside an urban one-lane, two way Temporary Traffic Control zone, employees were not facing traffic and sitting down while performing flagging operations and exposed to struck-by hazards while not utilizing appropriate signaling methods, such as facing road users in a stationary/standing position, that conform to Part 6 of the Manual of Uniform Traffic Control Devices.
