OSH Act of 1970 Section (5) (a) (1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck by hazards while performing tree trimming operations:  Jobsite: 5 Merriam St., Grafton, MA: On or about June 4, 2019, an employee performing tree felling was exposed to struck by hazards from an tree limb cut with a chain saw which relied on rigging to prevent his being struck.     Feasible and acceptable means to correct this hazard involve having employees follow the practices set forth in ANSI Z133.1-2017 for Arboricultural Operations Safety Requirements, including but not limited to the following specific sections below:  1. Ensure that employees follow the practices set forth in section 8.5.3 Arborists performing rigging operations shall be trained to estimate the potential forces at any point in the rigging system being used 2. Ensure that employees follow the practices set forth in section 8.5.4 Careful consideration shall be given to the potential for additional forces resulting from the influences of rigging design, rope angles, and the number of lines and/or line parts that will act on any rigging or anchor point.  3. Ensure that employees follow the practices set forth section 8.5.9.When establishing a rigging point horizontally distant from the parent limb or main tree stem,the arborist should consider the need to provide additional support to help disperse the force of the proposed rigged load  4. Ensure that employees follow the practices set forth section 8.5.16 Workers aloft shall position themselves above or to the side of the piece being rigged and out of the path of movement of the piece and attached rigging when the piece has been cut.
