29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Job Site - Employees were not provided with training in the importance of using personal protective equipment, including eye protection and personal fall arrest equipment while performing roofing work operations, on or about 06/05/2019.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  a) Roof - Employee was cutting  wood sub roofing using a Hilti portable battery operated circular saw and not wearing eye protection, on or about 06/05/2019.  No abatement certification or documentation required for this item.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Roof - Employees were on a roof that measured 17 feet by 35 feet while prepping the roof for new fiberglass shingles and exposed to a 22 foot fall hazard, on or about 06/05/2019.  R & H Pro Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1323509, citation number 1, item number 1, and was affirmed as a final order on November 26, 2018, with respect to a workplace located at 2901 24th Street, NW Washington DC 20017.  No abatement certification or documentation required for this item.
