29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) At the time of the inspection, Barge 140 located in Emmonak, AK at the up river end of the barge, the guardrail did not extend to the corner of the barge leaving a space of approximately five feet of unprotected edge where employees were exposed to a fall hazard of more than 4 feet. b) At the time of the inspection, Barge 140 located in Emmonak, AK at the down river side of the barge, had stanchions but did not have a guardrail in place leaving the entire width of 140 barge edge unprotected and exposing employees to a fall hazard of approximately 6 feet into the water.

29 CFR 1910.29(b)(10): The employer did not ensure when guardrail systems used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails. a) Hoisting area on Barge 140 shore side did not have a mid rail to protect employees from fall hazards of approximately 10 feet to the lower deck.
