29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept in a clean, orderly, and sanitary condition:    (a) On or about May 29, 2019, the employer did not ensure that employees working on the mezzanine conducting paint mixing operations were protected from slip, trip, or fall hazards from material, dry cement, paint hoses, and electrical cords. An employee conducting paint mixing operations tripped over a cord and while trying to prevent her fall, employee reached out to a gate used to deliver material. The gate swung open and the employee fell approximately 8 feet into a cement hopper.    Abatement Note: Abatement certification is required for this item (See enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.29(b)(13)(i): The guardrail system opening used around holes that serve as points of access (such as ladderways),  did not have a self-closing gate that slides or swings away from the hole, and was equipped with a top rail and mid-rail or equivalent intermediate member that met the requirements in paragraph (b) of this section:  (a) On or about May 29, 2019, the employer did not ensure that a gate on the mezzanine where paint mixing operations take place was properly secured and had a self-closing gate that swung away from the edge of the mezzanine. This resulted in an employee falling approximately 8 feet into a cement hopper after the employee tripped over a cord and while trying to prevent her fall, reached out to the gate, and the gate swung open. 29 CFR 1910.212(a)(2): Guard(s) on machine(s) were not affixed to the machine or secured elsewhere when attachment to the machine was not possible:    (a) On or about May 31, 2019, and at times prior, the employer did not ensure that employees conducting cement filling operations were protected from amputation hazards from an auger in the filler machine which had a guard that was not properly secured to the opening of the auger. An employee suffered an amputation to his right index and middle finger when he reached under the guard to try to stop cement from continuing to flow.
