OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: (a) On or about June 13, 2019, the operator of the Komatsu WA 200PZ loader was exposed to crushing and roadway injuries in that he did not use the manufacturer installed seatbelt while operating the loader at the construction site and on the public road.

(a) On or about June 13, 2019, a worker was exposed to cave-in hazards while working inside of a vertical cut trench in a road that ranged in depth from 5 to 5 feet 7 inches, and worked outside of the trench box.
