29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  a) East side of site. On or about June 13, 2019, an employee was exposed to a caught-in hazard while shoveling dirt in a trench, without having adequate cave-in protection, and a ladder for egress.  b) West side of site. On or about June 21, 2019, an employee was exposed to a caught-in hazard while shoveling dirt in a trench, without having adequate cave-in protection, and a ladder for egress.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  East side of site.  On or about June 13, 2019, an employee was exposed to fall and caught-in hazards while working in an excavation without a safe means of egress.

Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  West side of site.  On or about June 21, 2019, an employee was exposed to a struck-by hazard while shoveling dirt in a trench with no protection from the spoil pile less than 2 feet from the edge.

On or about June 21, 2019, employees were exposed to a caught-in hazard while working in an excavation greater than 5 feet in depth, with no designed support system, shielding system or other protective system installed.
